Agreement to Terms

These Terms of Service govern your use of taviopath (taviopath Limited) and its services. By accessing and using our website and booking any hot air balloon flight experiences, you acknowledge that you have read, understood, and agree to be bound by these terms in their entirety. If you do not agree to these terms, please do not use our services or attempt to book any flights with us.

Scope of Services

We offer hot air balloon flight experiences in the taviopath countryside, featuring sunrise flights with champagne celebrations upon landing. Our services include professional balloon operations, experienced pilot guidance, scenic aerial views of the Lithuanian countryside, and a curated landing experience with complimentary champagne. All flights operate subject to weather conditions and are conducted in compliance with aviation safety regulations. The experiences are designed for adults and accompanied children, with specific age and health requirements that must be met prior to flight.

User Obligations

As a user of our services, you agree to:

• Provide accurate and truthful information when making flight bookings
• Disclose any medical conditions or physical limitations that may affect your ability to fly safely
• Comply with all safety instructions provided by our crew members
• Arrive at the designated meeting location on time and prepared
• Follow all posted rules and regulations at our facilities
• Not engage in behavior that endangers yourself or others
• Respect the privacy and property rights of other participants and our staff

Intellectual Property Rights

All content on our website, including text, images, photographs, videos, graphics, and logos, is the exclusive property of our company or our content suppliers and is protected by international copyright laws. You may not reproduce, distribute, transmit, modify, or otherwise use any content without our prior written permission. Photographs and videos taken during your flight experience remain our intellectual property unless otherwise agreed in writing. We grant you a limited license to use content for personal, non-commercial purposes only.

Limitations of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or website. We do not guarantee uninterrupted service or error-free operation. Flights may be cancelled or delayed due to weather conditions, mechanical issues, or safety concerns, and we reserve the right to make such determinations at our sole discretion. We are not responsible for personal injuries, property damage, or loss of personal items during flights, except where required by applicable law.

Cancellation and Refund Policy

Cancellations made 14 days or more before your scheduled flight are eligible for a full refund. Cancellations made between 7 and 14 days before the flight will receive a 50% refund. Cancellations made less than 7 days before the flight are non-refundable. We reserve the right to cancel flights due to adverse weather, safety concerns, or operational issues, in which case we will offer a full refund or rescheduling at no additional cost. No refunds will be issued for cancellations due to participant no-show without prior notice.

Termination of Access

We reserve the right to suspend or terminate your access to our website and services at any time, for any reason, including but not limited to violation of these terms, abusive behavior, or safety concerns. Termination may be effective immediately without notice. Upon termination, your right to use our services ceases immediately. We are not liable for any damages resulting from suspension or termination of your account or access to our services. Outstanding payment obligations remain in effect following termination.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Lithuania, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Vilnius, Lithuania for the resolution of any disputes arising from these terms or your use of our services. This choice of law and jurisdiction applies regardless of your location or the location from which you access our website.

Modifications to Terms

We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or other factors. We will notify you of material changes by posting the updated terms on our website and updating the "Last updated" date. Your continued use of our services following the posting of revised terms constitutes your acceptance of the updated terms. We encourage you to review these terms periodically to stay informed of any changes.

Entire Agreement

These Terms of Service, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and us regarding your use of our website and services. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect. Our failure to enforce any right does not constitute a waiver of that right.
